Effective Date: 1st September 2025
These Terms & Conditions of Sale (“Terms”) set out the contractual terms under which I, Luis Garza, carrying on business as The Glove Pope from Fullerton, California (“I”, “me”, or “my”), sell products and provide repair or customization services to customers through my website www.TheGlovePope.com (the “Website”).
By placing an order for products or repair services through the Website, you (“Customer”, “you”, or “your”) acknowledge and agree to be bound by these Terms, together with my Shipping Policy, Returns & Refunds Policy, and Privacy Policy, each of which forms an integral part of this agreement.
1. Orders and Acceptance
1.1 All orders are subject to acceptance by me. I reserve the right to refuse or cancel any order, in whole or in part, at my sole discretion where there is an error in pricing, product availability, or suspected fraudulent activity.
1.2 A binding contract is formed when I confirm acceptance of your order in writing (including by email) or by processing payment and commencing fulfilment.
2. Shipping and Delivery
2.1 Shipping shall be arranged strictly in accordance with my Shipping Policy, as amended from time to time.
2.2 For repair services, the Customer shall be solely responsible for ensuring safe shipment of gloves to my designated facility. The Glove Pope shall, unless otherwise agreed, bear the cost of return shipping via USPS Priority Mail once repairs are completed.
2.3 Risk of loss or damage to items passes to the Customer upon my delivery of the items into the custody of USPS or another authorized carrier.
3. Repairs and Services
3.1 All repair work is deemed final upon completion. If you believe there is an issue with workmanship, you must notify me within seven (7) days of receiving the repaired glove. I will review and, where appropriate, take reasonable steps to rectify workmanship issues, provided such issues are not the result of normal wear, misuse, or improper care.
3.2 I shall not be liable for defects or damage arising from misuse, neglect, improper application of cleaning or conditioning products, or unauthorized alterations carried out after delivery.
4. Customizations
4.1 Customizations, including without limitation lace color, break-in style, dye treatments, or any other bespoke modifications, are performed to the Customer’s specifications.
4.2 For the avoidance of doubt, all customizations are strictly non-returnable and non-refundable.
5. Products
5.1 Products (including but not limited to cleaners, conditioners, and accessories) are supplied subject to the Returns & Refunds Policy.
5.2 I disclaim all liability for damage or injury arising out of improper application, misuse, or failure to follow instructions in connection with such products
6. Pricing and Payment
6.1 Prices are displayed in Canadian dollars (CAD) unless otherwise indicated. All prices are subject to change without notice.
6.2 Payment in full is required at the time of order. Orders will not be processed or shipped until payment has been received in cleared funds.
6.3 Payments are processed securely by third-party payment processors. I do not collect or retain your full payment details.
7. Limitation of Liability
7.1 To the fullest extent permitted by law, I shall not be liable, whether in contract, tort (including negligence), or otherwise, for any indirect, incidental, consequential, or special damages, including without limitation loss of profits, revenue, or data, arising out of or in connection with the purchase, use, or repair of products or services.
7.2 Nothing in these Terms shall exclude or limit liability for death or personal injury caused by negligence, fraud, or any other liability which cannot be excluded under applicable law.
8. Amendments
I reserve the right to amend, modify, or update these Terms at any time by posting the revised version on the Website. The effective date will be updated accordingly. Continued use of the Website or placement of further orders following such amendments constitutes acceptance of the revised Terms.
9. Governing Law
These Terms, and any disputes arising in connection with them, shall be governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein. You agree to submit to the exclusive jurisdiction of the courts of British Columbia.
